1.     It is understood that said Sheltie is a good representation of its breed and 
is 
understood by the buyer to be of Shown/Breeding quality on information 
available at that time.  It is not a guaranty of size, dental, or that the puppy 
will become show quality as an adult.  All measurements will be provided
at the time of purchase.  If purchasing an adult dog, size will be disclosed
and quarenteed at that time.  It is the responsiblity of the buyer to educate 
themself on the breed standard prior to purchase.

 

 2.     It is understood that the above dog will be registered by the new owners 
 through AKC with  “Breyston” being the first name prior to any other on 
registration. 

 

3.   Buyer agrees to show said dog a minimun of 10 times within 2 years from 
date of purchase.  In the event the dog points in this time, buyer agrees to
continue to show the dog working toward an AKC Championship and use
a handler if necessary for major points.  If the dog does not point in the two
years buyer is under no further obligation to keep showing.
 

 

4.     FEMALE SHELTIE - Seller shall pick a FIRST PICK puppy from the above 
Sheltie's FIRST LITTER.  Said sheltie will be as co-ownership with Seller 
until this requirement is met. Said sheltie shall not be bred until second heat 
or after. For the FIRST LITTER, said sheltie  shall be bred to an AKC 
registered Champion stud male approved by seller or an AKC registered stud
male that has been approved by the seller.  All breeding expenses and care of 
the litter will be the expense of the buyers.  If seller is not notified of bitches heat 
in time to choose stud or bitch is bred to a dog without prior consent from seller,
seller will have the option to to choose a puppy from this breeding or be entitled
to a penalty of  $1000 from the buyer.  Seller will still retain the right to FIRST PICK  
of the next litter. Seller will make FIRST PICK between the 8-10 week age, at 
which point seller will sign off as co-owner on sheltie' papers.  No puppies may be 
sold or promised before this time without Seller's prior consent.  Buyer is to
provide pictures, video, measurments if the availablity for seller is not possibly due to 
distance of locxation.  Puppies are to be in good health and condition at time of 
pick up.  Any expense incurred by seller to care and cure sick puppy will be the
responsiblity of the buyer. Seller will be able to name her puppy and place 
Breyston prefix to her name. 
This dog may not be spayed or sold unless all terms of contract are met, ie: puppy
back, payments, etc. unless the health of the dog is compromised, at which point  
prior arrangements must be made in writing and signed by the seller.  If the dog 
is spayed or sold without prior consent from Seller, a $2000 *two thoussand) 
penalty fee will be due.

MALE SHELTIE
-  Said sheltie above will be sold outright with an agreement
that Seller is entitled to two free breedings a year for 5 years after purchased.
Seller may breed to any bitch owned, co-owned or leased by seller.  This dog 
may not be neutered or sold unless all terms of contract are met, unless the
health of the dog is compromised, at which point prior arrangements must be 
made in writing and signed by the seller. 
 

5.     If at ANY time during the life of said sheltie above it becomes available, Seller 
shall have the first option to purchase this dog back.  The purchase back price 
will not exceed the original purchase price of the buyer.

If said dog is sold to someone else, the Buyer is to notify the Seller and give 
Seller the new owners contact information. 

6.   If it is found that the above dog or any of it's puppies have been surrendered 
or sold to a pet store, wholesale outlet, dog pound/shelter or rescue organization, by Buyer,
Seller reserves the right to take immediate repossession of dogs and fine Buyer $2000 
(two thousand). Any fine incurred will be donated to ASSA Sheltie rescue by 
seller. If the dog is found to be abused or neglected the Seller reserves the 
right to take immediate possession of the dog.

7.     Said sheltie above is being sold with a health and hereditary guarantee, Buyer
       agrees to have a Veterinarian check the sheltie with (5) five days of purchase 
       or guarantee is void. 
 
 
Both the Buyer and Seller have read the above contract and understand and 
agree to all the conditions stated herein. The heath/hereditary addendum is also 
a part of the contract. This contract is legal and binding.  Both parties agree that 
any legal action to enforce this contract will be brought forth in Montgomery 
County, Texas where breeder resides.
